Effective 4th July 2016, land owners and owner-builders are responsible for ensuring any works undertaken on their land, whether by them or another person, has a Building Permit in place.
Where a building practitioner and architect are contracted to undertake the services, they are responsible for ensuring a building permit has been issued prior to commencement of any building work; and that the work complies with the Act, the Regulations and the permit.
Heavy penalties will apply where breaches of the law are found to be evident, this includes $379,175 for companies and $75,835 per offence for individuals.
The two applicable offences individuals may be liable for are:
> the offence of carrying out building work without a current building permit
> the offence of carrying out building work in breach of the Act, the Regulations or the permit
