The most recent Ministerial Order released on 11 July will come into effect on 12 August 2019.

The ‘Order’ will now enable the VBA to accept policies with cladding exclusions. Previously, the Building Act did not permit practitioners to maintain exclusions on their Professional Indemnity Insurances, in turn, ceasing their ability to practice as a building certifier or inspector.
This is a welcomed action taken by the Government, albeit, a bandaid to what is a larger issue to be addressed.
Whilst the VBA will consider policies that meet the minimum requirements as compliant, it is recommended that practitioners should seek or obtain unencumbered insurance where available.
